This Privacy Policy (“Privacy Policy”) describes how we collect, use, disclose, and otherwise process personal information and content in connection with our mobile application, web application, website, social media pages, marketing activities, events, communications, and other products and services that link to this Privacy Policy (collectively, the “Service” or the “App”). At The Nod, we believe trusted recommendations should be shared safely and transparently. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices available to you.
We may provide additional or supplemental privacy notices for certain products, services, features, programs, events, promotions, or opportunities, and those notices will apply to the personal information collected or processed in connection with those specific activities.
By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. For purposes of this Privacy Policy, “User,” “you,” and “your” mean any individual or entity that accesses, browses, applies for, downloads, gets approved, or otherwise uses the Service. This Privacy Policy applies to all Users of the Service, including individuals who browse or view content, individuals who apply to create a profile, approved users who create profiles or upload recommendations, and other individuals who interact with us online or offline.
If you access or use the Service from outside the United States, you understand that your personal information may be processed in the United States and other jurisdictions where we or our service providers operate.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or the features of the Service. When we make changes, we will update the “Effective Date” above and post the revised Privacy Policy on the Service or otherwise make it available to you. Your continued use of the Service after any update constitutes your acknowledgement of the revised Privacy Policy.
PERSONAL INFORMATION WE COLLECT
We collect personal information that you provide to us, personal information generated through your use of the Service, personal information collected automatically, and personal information we may receive from third parties or other users.
Information You Provide Us. You may provide personal information to us when you access or use the Service, apply for an account, create or update a profile, upload content, communicate with us, participate in marketing activities or events, respond to surveys, or otherwise interact with us. This information may include, but is not limited to, your name, email address, phone number, username, password, profile photo, social media handles, location, city, creator or professional affiliation, biographical information, audience or creator-related information, and any other information you choose to provide.
Application and Approval Information. In order to request access to create a profile or upload recommendations through the Service, you may be required to complete an application or approval process. As part of that process, we may collect information such as your name, contact information, social media handles, location, creator or professional affiliation, audience information, hospitality or travel interests, and any other information you submit in connection with your application. We use this information to evaluate applications, verify eligibility, maintain the quality and integrity of the Service, protect the community, and determine whether to approve, deny, suspend, or modify access to certain features of the Service.
Account and Profile Information. If you are approved to create an account or profile, we may collect and maintain information associated with your account, including your login credentials, account settings, profile details, profile image, biography, linked social media accounts, location, preferences, saved places, recommendations, and other information you add to your profile. Some profile information may be visible to other users, public visitors, people who receive shared links, and users of The Nod’s related applications, platforms, or services, depending on the features of the Service and your settings.
User Content and Recommendation Information. The Service allows approved users to upload, post, submit, share, or otherwise make available content, including photos, images, captions, notes, recommendations, saved places, location tags, activity updates, comments, links, and other content or information (“User Content”). User Content may include metadata, such as when, where, and how content was created, uploaded, edited, shared, or interacted with. Metadata may also include location information, keywords, tags, formatting information, device information, and other associated data. Because The Nod is designed as a discovery platform, User Content may be visible to other users, public visitors, businesses, people who receive shared links, and users of related applications, platforms, or services operated by The Nod. User Content may also be copied, saved, screenshotted, shared, cached, or otherwise used by others, and we are not responsible for how others use information that you choose to make publicly or semi-publicly available.
Communications Information. We may collect information when you communicate with us, including when you contact us by email, SMS, in-app message, social media, customer support channels, surveys, forms, or other means. This may include the content of your message, your contact information, and any information you choose to provide. We may also collect information about your interactions with our communications, such as whether you open an email, click a link, respond to a message, or engage with a notification.
Information Others Provide. Other users may provide information about you when they use the Service. For example, another user may mention you, share content with you, submit information involving you, invite you to use the Service, report content or activity involving you, or otherwise communicate with us about you. We may process this information to operate the Service, maintain safety and integrity, respond to reports, enforce our Terms of Service, and improve the user experience.
Information Collected Automatically. When you access or use the Service, we, our service providers, and our analytics or technology partners may automatically collect information about your device, browser, network, and activity. This may include your IP address, device type, operating system, browser type, mobile carrier, device identifiers, app version, language settings, general location information, pages or screens viewed, links clicked, features used, access times, session duration, referring pages, and other information about your interactions with the Service.
Location Information. We may collect general location information, such as city, state, or geographic area, based on your IP address or other technical information. If you authorize the Service to access your device location, we may collect precise geolocation data to provide location-based features, such as showing nearby recommendations, location-relevant content, maps, or other location-based functionality. Depending on where you are located, precise geolocation data may be considered sensitive personal information, and we will collect or process it only as permitted by applicable law. You can enable or disable location access through your device settings.
Mobile App Permissions. Depending on the features you use, the App may request access to certain device permissions, such as location, camera, photo library, notifications, or other device features. For example, we may request access to your photo library or camera so you can upload images, or request notification permissions so we can send account, application, security, or Service-related updates. You can manage mobile app permissions through your device settings. If you disable certain permissions, some features of the Service may not function properly.
Cookies and Similar Technologies. We and our service providers may use cookies, pixels, software development kits, local storage, and similar technologies to operate the Service, authenticate users, remember preferences, analyze usage, improve performance, understand engagement, measure marketing effectiveness, and support security. Some browsers and devices allow you to control cookies or tracking technologies through settings. Where required by law, we will obtain your consent before using non-essential cookies or similar technologies. If you disable cookies or similar technologies, some features of the Service may not work as intended. Some browsers and devices offer “Do Not Track” or similar signals. Because there is not yet a uniform industry standard for responding to these signals, we do not currently respond to Do Not Track signals unless required by applicable law.
Information from Third Parties. We may receive personal information about you from third parties, such as social media platforms, analytics providers, marketing partners, event partners, service providers, public sources, businesses, creators, or other users. For example, if you link a social media account, interact with us on social media, attend an event, participate in a promotion, or are referred to us by another person, we may receive information related to that interaction.
Information About Others. If you provide us with information about another person, such as by sharing content, inviting someone to the Service, submitting a referral, or otherwise providing another person’s contact information, you represent that you have permission to provide that information to us.
Financial Information. The current version of the Service may not include payments or in-platform purchases. If we offer paid features, subscriptions, purchases, bookings, creator payments, or other payment-related functionality in the future, payment information may be processed by third-party payment processors, app stores, booking platforms, or other payment providers. We do not intend to collect or store full payment card numbers directly through the Service unless we provide additional notice.
HOW WE USE PERSONAL INFORMATION
We use personal information for the purposes described in this Privacy Policy, as disclosed at the time of collection, or as otherwise permitted by law. This includes where necessary to provide the Service, where we have your consent, where required to comply with legal obligations, and where necessary for our legitimate business interests.
Service Delivery and Operations. We use personal information to provide, operate, maintain, and improve the Service. This includes creating and managing accounts, processing applications, approving or denying access to profile creation features, enabling users to upload and share recommendations, displaying profiles and User Content, personalizing the Service, providing maps or location-based features, supporting sharing functionality, maintaining account settings, and responding to requests, questions, and feedback. We may also use personal information to send transactional and Service-related communications, including emails, push notifications, in-app messages, SMS/text messages, and other communications regarding your account, application status, profile, security, updates to the Service, changes to our policies, or customer support.
Application Review and Community Integrity. We use application and profile information to evaluate requests to join or access certain features of the Service, maintain the quality and integrity of the community, prevent misuse, verify eligibility, and determine whether to approve, deny, suspend, terminate, or modify access to the Service or certain features. We may also use personal information to monitor compliance with our Terms of Service, Community Guidelines, and other policies, and to protect the safety, trust, authenticity, and intended use of the Service.
User Content, Discovery, and Sharing. We use User Content and related information to display, organize, distribute, and promote recommendations, profiles, saved places, notes, photos, captions, location tags, and other content through the Service. We may use this information to power discovery features, search, maps, collections, public or shared links, recommendations, content feeds, user profiles, and related applications, platforms, or services operated by The Nod.
Communications. We use personal information to communicate with you about the Service, including account updates, application status, administrative messages, customer support, security alerts, policy updates, feature announcements, marketing communications, event invitations, creator opportunities, brand opportunities, surveys, and other information that may be relevant to you. If you receive marketing emails from us, you may opt out by following the unsubscribe instructions in the email. If you receive text messages from us, you may opt out by replying STOP, unless otherwise stated in the message. Even if you opt out of marketing communications, we may still send you non-marketing communications, such as account, security, transactional, or legal notices.
Analytics, Research, and Service Improvement. We use personal information to understand how users interact with the Service, measure performance, analyze usage trends, improve features, troubleshoot issues, conduct research, develop new products and services, and improve our business. We may create aggregated, de-identified, or anonymized information from personal information. We may use and share aggregated, de-identified, or anonymized information for lawful business purposes, including analytics, research, product development, investor reporting, business development, and marketing, provided that such information does not identify you. We may also generate aggregated, anonymized, de-identified, or statistical insights regarding user engagement, recommendation activity, discovery behavior, hospitality demand, travel trends, geographic activity, content performance, and other platform usage patterns. We may use and share such insights with hospitality businesses, travel partners, advertisers, investors, research partners, and other third parties, provided such information does not identify any individual user.
Marketing, Events, and Opportunities. We may use personal information to send marketing communications, promote the Service, invite you to events, administer surveys, contests, promotions, or waitlists, and contact you about opportunities that may be relevant to you. For Users, this may include contacting you about potential creator, hospitality, travel, restaurant, nightlife, brand, campaign, in-kind, paid, promotional, affiliate, booking, or other opportunities, whether offered through the Service or outside of the Service.
Future Commercial Features. The current version of the Service may not include payments, in-platform offers, bookings, affiliate links, paid campaigns, or brand collaboration tools. However, we may use personal information to develop, test, support, or offer future features involving User opportunities, rewards, business partnerships, affiliate links, booking links, promotions, discounts, offers, or other commercial programs. If we introduce materially different data practices in connection with future commercial features, we will update this Privacy Policy or provide additional notice as required by law.
Safety, Security, Fraud Prevention, and Legal Compliance. We use personal information to protect the Service, Users, the Company, businesses, and third parties. This includes detecting, preventing, investigating, and responding to fraud, spam, abuse, harassment, unauthorized access, security incidents, illegal activity, policy violations, intellectual property violations, and other harmful or unauthorized conduct. Other Users and the Public. Because The Nod is designed as a discovery platform, certain information you provide through the Service may be visible to other users, public visitors, businesses, people who receive shared links, and users of The Nod’s related applications, platforms, or services. This may include your profile information, profile photo, username, biography, social media links, recommendations, saved places, photos, captions, notes, location tags, activity updates, collections, shared links, and other User Content. Please understand that information you make available through the Service may be viewed, copied, saved, screenshotted, shared, cached, indexed, or otherwise used by others, including outside of the Service. We are not responsible for how other users or third parties use information that you choose to make publicly or semi-publicly available.
Service Providers. We may disclose personal information to vendors, service providers, contractors, and other third parties that perform services on our behalf or help us operate the Service. These may include providers of hosting, cloud storage, analytics, customer support, communications, email delivery, SMS/text messaging, push notifications, security, fraud prevention, data processing, payment processing if applicable in the future, marketing, product development, and other operational services. These service providers may access personal information only as reasonably necessary to perform services for us and are expected to protect personal information in accordance with applicable law and contractual obligations.
Analytics and Technology Partners. We may disclose personal information or make certain information available to analytics, measurement, and technology partners (such as analytics service providers) to help us understand how users interact with the Service, measure performance, improve functionality, troubleshoot issues, personalize user experiences, and develop new features. This may include device information, browser information, IP address, usage data, interaction data, pages or screens viewed, links clicked, session information, referral information, feature engagement data, and other technical or analytics information collected through the Service. We may also use session replay and similar technologies to better understand how users navigate and interact with the Service, diagnose technical issues, and improve the user experience.
Business, Hospitality, Creator, and Opportunity Partners. We may disclose personal information to business, hospitality, creator, marketing, event, or opportunity partners when necessary to provide, support, or coordinate features, opportunities, events, campaigns, partnerships, or other programs that you request, participate in, or may be eligible for. For Users, this may include sharing limited profile, contact, social media, application, audience, location, recommendation, or engagement information with potential brand, hospitality, restaurant, nightlife, travel, event, creator, affiliate, booking, or promotional partners, where permitted by law and consistent with this Privacy Policy. The current version of the Service may not include in-platform payments, offers, bookings, or brand collaboration tools. If we introduce materially different commercial features, we will update this Privacy Policy or provide additional notice as required by law.
Related Applications and Services. We may disclose, use, share, and display your profile information, User Content, and related data across The Nod’s related applications, platforms, websites, mobile applications, web applications, tools, dashboards, and services. For example, content or profile information submitted through one version of the Service may be displayed, used, or made available through another version of the Service, including our mobile app, web app, website, public links, creator profiles, business-facing tools, or future related products. Access to one application, platform, or feature does not guarantee access to any other application, platform, or feature.
Social Media Platforms and Third-Party Integrations. If you choose to connect, link, share, or interact with the Service through a social media platform or third-party service, we may disclose information to or receive information from that platform or service as necessary to enable the feature. For example, if you link a social media account, import profile information, share a recommendation, collection, profile, or other content, use a share icon, click a third-party link, or otherwise interact with content through another platform, your information may be processed by that third party according to its own terms and privacy policy. We are not responsible for the privacy practices of third-party platforms, websites, applications, or services.
Legal, Safety, and Enforcement Purposes. We may disclose personal information if we believe in good faith that disclosure is necessary or appropriate to comply with applicable law, regulation, legal process, subpoena, court order, government request, or law enforcement request. We may also disclose personal information to enforce our Terms of Service, Community Guidelines, or other policies; protect the rights, privacy, safety, or property of The Nod, our users, businesses, partners, or the public; detect, prevent, investigate, or respond to fraud, abuse, security incidents, illegal activity, intellectual property violations, or other harmful conduct; or establish, exercise, or defend legal claims.
Business Transfers. Please note that deleting or editing User Content may not remove copies that have already been viewed, shared, saved, cached, indexed, screenshotted, or otherwise retained by other users, public visitors, third-party platforms, search engines, or our service providers. We may also retain copies of User Content as reasonably necessary for legal, safety, security, backup, fraud prevention, dispute resolution, enforcement, or legitimate business purposes.
Communications Preferences. By creating an account or otherwise using the Service, you agree that we may send you Service-related communications, including account-related messages, authentication codes, security alerts, application status updates, transactional messages, legal notices, policy updates, and other communications necessary to provide the Service. We may also send marketing and promotional communications where permitted by applicable law. You may opt out of marketing emails by following the unsubscribe instructions included in those emails. You may opt out of marketing SMS/text messages by replying STOP, unless otherwise stated in the message. Even if you opt out of marketing communications, we may still send you non-marketing communications, including account-related messages, application status updates, transactional messages, security alerts, legal notices, policy updates, and other Service-related communications.
Push Notifications. If you enable push notifications, we may send you notifications regarding your account, application status, profile, activity, recommendations, updates, opportunities, security, or other Service-related matters. You can manage push notification preferences through your device settings.
Location Settings. If you authorize the Service to access your device location, you may disable location access through your device settings. If you disable location access, certain location-based features, such as nearby recommendations, maps, bulk photo uploads, or location-relevant content, may not function properly.
Camera, Photo Library, and Device Permissions. You can manage access to your camera, photo library, notifications, location, and other device permissions through your device settings. If you disable certain permissions, some features of the Service may not be available or may not function as intended.
Cookies and Similar Technologies. You may be able to manage cookies and similar technologies through your browser or device settings. Where required by law, we will obtain your consent before using non-essential cookies or similar technologies. If you disable cookies or similar technologies, some features of the Service may not work properly.
Third-Party Platforms. If you connect or interact with the Service through a third-party platform, such as a social media platform, app store, analytics provider, or other third-party service, your choices may also be governed by that third party’s privacy settings, terms, and policies. We encourage you to review the privacy settings and policies of any third-party services you use.
Account Deletion. You may request deletion of your account by contacting us at info@thenodcollective.com or by using any account deletion tools made available through the Service. If account creation is available through the App, we will provide an account deletion option within the App where required by applicable platform rules or law. Following an account deletion request, we may delete, de-identify, or anonymize personal information associated with your account, subject to applicable law and our retention practices described below.
DATA RETENTION
We retain personal information for as long as reasonably necessary to provide, maintain, protect, and improve the Service; operate our business; maintain accounts and profiles; process applications; provide customer support; comply with legal obligations; resolve disputes; enforce our agreements and policies; prevent fraud, abuse, or misuse; protect the safety, integrity, and security of the Service; and fulfill the purposes described in this Privacy Policy.
The length of time we retain personal information may vary depending on the type of information, the purpose for which it was collected, the sensitivity of the information, legal or regulatory requirements, operational needs, security needs, and whether retention is necessary to protect our rights, users, businesses, partners, or the public.
If you delete your account or request deletion of your personal information, we may retain certain information for a limited period as reasonably necessary for backup, archival, legal, safety, security, fraud prevention, dispute resolution, enforcement, or legitimate business purposes.
We may retain account information and related records for a reasonable period after account deletion for a limited period for safety, security, fraud prevention, abuse prevention, dispute resolution, and community integrity purposes, unless a longer retention period is required or permitted by law.
We may retain User Content or related information where necessary to comply with legal obligations, enforce our Terms of Service, investigate violations, resolve disputes, maintain business records, protect the safety or integrity of the Service, or where the content has been shared publicly or with others and cannot reasonably be removed from all locations. We may retain aggregated, de-identified, or anonymized information indefinitely, provided that such information does not identify you and is not reasonably capable of being used to identify you.
INTERNATIONAL DATA TRANSFERS
The Nod is based in the United States, and we may process, store, and transfer personal information in the United States and other countries where we or our service providers operate. If you access or use the Service from outside the United States, you understand that your personal information may be transferred to, stored in, and processed in the United States and other jurisdictions that may have data protection laws different from those in your country of residence. These rights may include the right to request access to personal information we maintain about you, request correction of inaccurate personal information, request deletion of personal information, request a copy of your personal information, object to or restrict certain processing, withdraw consent where processing is based on consent, or appeal a decision we make regarding your privacy request. The Service may contain links to or integrations with third-party websites, applications, platforms, booking services, reservation platforms, social media platforms, maps, analytics providers, app stores, or other third-party services. If you click a third-party link, share content through a third-party platform, connect a third-party account, or otherwise interact with a third-party service, your information may be collected, used, and disclosed by that third party according to its own terms and privacy policy. We are not responsible for the privacy practices, security practices, content, or policies of third-party services. We encourage you to review the privacy policies of any third-party services you use.
CHILDREN’S PRIVACY
The Service is not directed to children, and we do not knowingly collect personal information from children in violation of applicable law. If you are under the age at which you may legally consent to the processing of your personal information in your jurisdiction, you may use the Service only with the permission and involvement of your parent or legal guardian where required by applicable law.
In the United States, the Service is not intended for children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen (13).
